The McKinsey & Company, Capital Projects and Infrastructure Report “The new age of engineering and construction technology” highlights how the engineering and construction (E&C) industry is at the cusp of a new era. New technologies, such as weather risk management, are rapidly transforming all stages of the engineering and construction process, through advanced software, construction-focused hardware, and analytics capabilities.

Weather is one of the top three reasons for missed milestones in the construction industry and built environment, with negative impacts costing billions of dollars. Further, McKinsey explains how innovating new technologies are “…eliminating many of the problems that have dogged the E&C sector for decades…” which includes managing weather risk — to increase the impact of positive events, and to decrease the impact of negative events.

First, during the construction phase, equipment management technology helps to “track and manage construction-equipment fleet.” Leading equipment management technology integrates with hyper-local weather risk solutions to enable weather risk probability for each work breakdown structure (WBS), schedule activity, equipment operation, crew task, and its respective equipment and equipment-crew resources in the construction-equipment fleet.

Second, during the construction phase, quality control technology helps to “inspect remote sites through pictures and tags shared through app,” such as pictures and videos from weather stations and weather webcams — weather logging devices (WLD) capturing images of the sky and jobsite and logging data about weather events for historical record, risk management, claims management, and from time to time… dispute resolution.

And third, during the construction phase, contract management technology helps to “update and track contract-compliance checklists, and update records for all client and contractor communication regarding contract terms,” including weather events, schedule impacts and respective delays. Contract-compliance and contract terms include weather delays and extensions of time, and weather claims for additional time.

Contract language for weather delays and extensions of time, and weather claims for additional time includes clauses for the following AIA Contract Documents: A201™-2007 General Conditions of the Contract for Construction; A201™-2007 SP General Conditions of the Contract for Construction, Sustainable Project; and, A201™-2017 General Conditions of the Contract for Construction.

Further, contract language for weather delays and extensions of time, and weather claims for additional time addresses the following two clauses in the American Institute of Architects AIA A201™ General Conditions of the Contract for Construction: first, ARTICLE 8 TIME, § 8.3 Delays and Extensions of Time; and second, ARTICLE 15 CLAIMS AND DISPUTES, § 15.1.5 Claims for Additional Time.
