About one month ago, the Occupational Safety and Health Administration (OSHA, www.osha.ogv) released a series of proposed rules to address the outstanding issues related to crane operator certification 1926.1427 – Operator qualification and certification in 1926 Subpart CC – Cranes & Derricks in Construction. The OSHA Cranes & Derricks in Construction resources highlight how moving and lifting large and heavy loads is critical to today’s construction industry and built environment. OSHA presents an overview, and five groups of resources: Federal Register Notices, Standard Interpretations, Compliance Assistance, Presentations, and Additional Information.
Must adjust the equipment and/or operations to address the effect of wind, ice, and snow on equipment stability and rated capacity!
OSHA Regulations (Standards – 29 CFR), PART 1926 Safety and Health Regulations for Construction, 1926 Subpart CC – Cranes & Derricks in Construction, 1926.1417(n) states that “The competent person must adjust the equipment and/or operations to address the effect of wind, ice, and snow on equipment stability and rated capacity.” Further, 1926.1417(a) “The employer must comply with all manufacturer procedures applicable to the operational functions of equipment, including its use with attachments,” including safety procedures in the event of adverse weather such as wind and wind gusts, dangerous thunderstorms and lightning strikes, for example.
Right to working conditions that do not pose a risk of serious harm, such as weather events.
In Cranes & Derricks in Construction, OSHA also notes Workers’ Rights, where workers have the right to working conditions that do not pose a risk of serious harm, such as weather events, high winds and wind gusts, dangerous thunderstorms, and lightning strikes, for example. Under the Occupational Safety and Health (OSH) Act of 1970, employers, including contractors, owners and operators, are responsible for providing safe and healthful workplaces for employees. Accordingly, OSHA’s role is to ensure these conditions for America’s working men and women by setting and enforcing standards, and providing training, education and assistance.
